Constitutional validity of Sec 66A, 69A, &80 of IT Act
Common Cause filed a petition seeking to challenge the constitutional validity of various provisions of the amended Information Technology Act, 2000, under Article 32 of the Constitution of India by way of Public Interest Litigation, including Sections 66A, 69A and 80 as being violative of Articles 14, 19 & 21 of the Constitution of India. The petition was tagged along with along with Writ Petition (Crl.) No.167 of 2012.
The two-judge bench of the Supreme Court comprising Justice Chelameswar and Justice Nariman passed a landmark judgement dated March 24, 2015 wherein Section 66A of the IT Act, 2000 was struck down as being violative of Article 19(1)(a).
