Intervention Application (Cr.MP20460 of 2013) in WP (Cr.) 158/2013
Muzzaffarnagar riots investigation
Common Cause filed an intervention application in the Supreme Court seeking to be permitted to a party in the case of Supreme Court Bar Association vs Union of India (WP Crl No. 158 of 2013). The petition asserted that communal riots erupted in Muzaffarnagar, Shamli and its adjoining rural areas after a Mahapanchayat which was organized by the Jat community at Nagla Mandaur, 20 kms away from Muzaffarnagar city on 7 September 2013. It was alleged that the local administration instead of enforcing the law allowed the congregation not only to take place, negligently and perhaps with certain amount of complicity, but also failed to monitor its proceedings. The petition sought an inclusive protection for each victim whose fundamental rights have been infringed in the said riot by praying for numerous rehabilitative, protective and preventive measures to be adhered to by both the State and the Central Government.
Supreme Court, in its judgement dated March 26, 2014, gave several directions to the State administration. Some of the directions included making payment of compensation to rape victims of Rs. 5 lakhs; making arrests of the accused as well as providing security cover and financial assistance to the victims; providing financial assistance and rehabilitation measures to families that had lost lives or persons who had been injured or who had lost property.
