Summary :

On November 19, 2019, in IA No.105815/2019, the bench directed matter to be listed before the Constitution Bench headed by Justice Arun Mishra in the coming week. 

On December 11, 2019, the court permitted Dasti and ordered notice be served on the standing counsel within 3 days. As ordered on November 19, 2019, the Constitution bench consisting Justices Arun Mishra, Indira Banerjee, Vineet Saran, M.R. Shah and S. Ravindra Bhat heard the matter.

On January 22, 2020, the bench asked the Union of India to file a response within 10 days. The counsel indicated that they are trying to convene a joint meeting of all the stakeholders. The bench has allowed the joint meeting and asked to report if arrived at any consensus.

On September 29, 2022, the matter was relisted on November 23, 2022 by the bench consisting Justices KM Joseph, Ajay Rastogi, Aniruddha Bose, Hrishikesh Roy and CT Ravikumar.

On November 23, 2022, the five-judge bench consisting Justice KM Joseph, Justice Ajay Rastogi, Justice Aniruddha Bose, Justice Hrishikesh Roy and Justice CT Ravikumar heard the matter. SG Tushar Mehta, Senior Counsel Arvind Datar and Mr Bhushan pointed out that pursuant to earlier order dated 22.01.2020, efforts have been undertaken and at present the matter is engaging the attention of Ministry of Health, Union of India and the efforts may have to be made to arrive at suitable 2 draft guidelines which can be placed before this Court for consideration. Dr. R. R. Kishore was also heard and the matter was listed for consideration on 17th January, 2023.

On January 17, 2023, the matter was relisted to be heard on January 18, 2023. 

On January 18, 2023, the matter was relisted to be heard the next day.

On January 19, 2023, the matter was relisted to be heard on January 24, 2023.

On January 24, 2023, the five-judge bench headed by Justice KM Joseph and consisting of Justice Ajay Rastogi, Justice Aniruddha Bose, Justice Hrishikesh Roy and Justice CT Ravikumar heard and disposed of the matter.
